Police custody for Bangla nationals

GUWAHATI, Jan 24 – The Gauhati High Court today directed the Superintendent of Police, Udalguri to take Smt Parul Das and her husband Gaurango Das to police custody and to detain them till such time they are deported to Bangladesh, and the Superintendent of Police, Nalbari to take Md Mukshed Ali alias Makshid Ali of village Batamara under Mukalmara police station, Nalbari to police custody and to detain him till such time he is deported to Bangladesh and in both the judgment the SP’s have been directed to submit compliance reports on or before February 28. The petitioners – Parul Das and Gaurango Das had challenged the order dated 12.6.07 passed by the Foreigners Tribunal, Udalguri declaring them to be Bangladeshi nationals and Md Mukshed Ali had challenged to order of IMDT Tribunal and the Appellate Tribunal’s order whereby he was declared to be a Bangladeshi national.

Justice BK Sharma after hearing all the writ petitions dismissed them and upheld the judgment of Foreigners Tribunal, Udalguri and IMDT Tribunal orders. He observed, “it is irony of procedural practice being followed in this country that the Bangladeshi national was, after declaring him to be so, is roaming around in Indian soil freely even with right of franchise. Unless some strong action is taken in such a matter by powers that be, the fast changing demographic pattern of Assam reducing indigenous people to minority will attain its finality in near future.”
